HLUV'S COMMITMENT TO PRIVACY
HighFrequency Luv Inc. (“HLuv” or “we” or “us”) is committed to protecting your privacy. This Privacy Policy (“Privacy Policy”) describes HLuv’s personal information privacy policies and practices with respect to the collection, use and disclosure of your Personal Information (as defined below) through the Service offered at LuvHertz.com (the “Website”) or otherwise.
This Privacy Policy applies to all HighFrequency Luv Inc. sites, including but not limited to LuvHertz.com.
By accepting our Terms and Conditions, you expressly consent to our use and disclosure of your Personal Information in the manner described in this Privacy Policy. This Privacy Policy is incorporated into and subject to the terms of the Terms and Conditions. Any capitalized terms not defined in this Privacy Policy shall have the meanings set forth in the Terms and Conditions.
PERSONAL INFORMATION
“Personal Information” means any information that can be used to identify you, such as your name.
We will collect no more Personal Information from you than we need for you to use and access the Service and communicate with us. Please note that one of the primary reasons you and other Members will use the Service is to benefit from advice and feedback from other Members who have specific backgrounds and experiences. We therefore encourage you to provide as much information as you feel comfortable with in order to provide you with a unique and highly customized experience.
CHILDREN
The Service is intended for users over the age of 14. HLuv does not knowingly collect Personal Information from children under the age of 14.
YOUR CONSENT
Before we collect Personal Information from you, we will explain to you for what purposes we intend to use it. Our collection and use of such Personal Information will be limited to what we need for those purposes and we will obtain your consent if we wish to use your Personal Information for any other purpose.
If you submit the name and/or e-mail address of a friend to us to refer that friend to the Website, please ensure that you have his/her consent to do so. If you do not have your friend’s consent, please do not provide us with any of their personal information.
COLLECTION OF YOUR INFORMATION
In order to register as a Member on the Website, you are only required to provide your e-mail address, your age range (e.g. “18-24”) and to create a user name and password. We will never rent, lease or sell your e-mail address to any third-party. We ask that you refrain from including any Personal Information in your user name when choosing your user name.
Once you have activated your account pursuant to the registration process, you will be asked to provide Personal Information such as your gender, geographic location, relationship status, race/ethnicity, sexual orientation, education and relationship experiences. This information is requested in order to provide you with all of the features and functions available through or in connection with the Service. As described below, we may use this information for other purposes such as marketing, advertising and internal research, but only in a way such that your Personal Information is rendered anonymous and cannot be traced back to you.
We may collect information generated by your use of the Service, for example the comments you post, who you interact with and other interactions you have with the Service. This information is required for the purposes of providing you with the Service and if we use this information for any other purposes, we will obtain your consent prior to doing so.
We may also collect certain connection information from you such as your IP address, type of browser, location and the pages you visit on the Website, as well as the address of third-party websites you visited us from or visit after you leave the Website. This information will only be used for internal research purposes, unless we are required to disclose this information pursuant to applicable law.
We employ “cookies”, which are small data files stored by your browser on your computer, in order to provide you with a customized experience on the Service and to make the Website easier to access (by, for example, saving your login information – but not your password). We also use cookies to assist our marketing efforts and provide you with advertisements that may be of greater interest to you.
USE OF YOUR INFORMATION
We may use information you provide to us, including your Personal Information, to evaluate and improve the effectiveness of the Service. When other Members search for Members with certain characteristics, your Personal Information is used in determining whether you will receive, for example, a Survey request. Your Personal Information will never be disclosed to another Member in the course of the Service, except to the extent you have permitted your Personal Information to be made available for viewing by other Members, as discussed below; however, the Service is not meant to permit the disclosure of identifiable Personal Information to another Member.
We may also contact you via the e-mail address you registered with to provide you with information relating to the Service. You may opt-out of receiving all such e-mails, except for those containing information essential to the Service, by following the instructions indicated on our Help Page.
Please note that your Personal Information may be stored and processed on third-party servers in jurisdictions other than Canada, including the United States. The laws regarding the handling of personal data in other jurisdictions may differ from the laws of your country and therefore your Personal Information may be accessible to law enforcement and national security authorities of that jurisdiction, without an opportunity for you or HLuv to object to or otherwise oppose such access. However, as we explain below in Safeguards and Security, HLuv will use reasonably efforts to hold and transmit your Personal Information in a safe, confidential and secure environment.
DISCLOSURE OF YOUR INFORMATION
Your profile is available for other Members to view. Your viewable profile does not include any Personal Information about you, except to the extent that you choose to make such information viewable as described below. Please note that posting Personal Information that can be used to identify you or any other Member is prohibited by our Terms and Conditions.
Your viewable profile will display the username you chose upon registering and the attributes of your avatar. By default, your privacy settings will be set to “Private”, which means that no-one except you can view the various information you provided to create your Vibe and posts made to your LuvLog. Please consult our Help Page for information on how you may change your privacy settings for either your Vibe or your LuvLog posts.
We do not sell, trade, or rent your Personal Information to third-parties. We may use third-party advertisers to serve advertisements on our behalf or on behalf of third-party advertisers. These service providers will have access to anonymous, aggregate information to serve you personalized advertisements based on your demographic information (e.g. year of birth, gender, education, etc.). While we may disclose such general information about you, we will not share identifying Personal Information with any advertisers. However, such advertisers may employ the use of cookies, for example to remember your preferences. You may manage what cookies you accept through the configuration settings of your web browser.
Except as described in this Privacy Policy or as you may otherwise consent to from time to time, HLuv will not use, and will not disclose or provide any of your Personal Information to any other person. If we intend to use your Personal Information in any way we didn't tell you about previously, we will obtain your consent for the new purpose or use prior to doing so, if necessary pursuant to this Privacy Policy or otherwise required by law.
HLuv may sell all or part of its business, sell or securitize assets, or merge or amalgamate part or all of our business with other entities. Since customer information and data would normally be a part of such transactions, we may use or disclose your Personal Information to other parties included in the transaction, as part of due diligence activities and/or on the completion of the transaction. In the event that we are acquired by another company, you will be notified if there are any material changes to the way your Personal Information is collected or used.
EXCEPTIONS WHERE HLUV MAY COLLECT, USE OR DISCLOSE INFORMATION WITHOUT CONSENT
If we are required or permitted by law: We may be required to release Personal Information by a court of law or other legal or regulatory authority. If so, our policy is to release Personal Information only to the extent that we have to. We may also collect, use or disclose Personal Information without consent where permitted by law. For example, we may collect and use publicly available information like information in the telephone book for marketing or customer service purposes. Further, for other legal, medical, emergency or other security reasons, it may be impossible or impractical to seek or obtain your consent.
If we use an outside third party supplier to do work for us: We may from time to time use outside third party suppliers, including suppliers located in Canada and the United States, to do work for us involving some of your Personal Information. For example, to perform computer services on our behalf or to analyze Survey results or marketing data or to administer to manage promotions or contests or for other reasonable purposes. Such third party suppliers will only use your Personal Information for the purposes that you have consented to or consent to in the future.
If we have to protect the interests of HLuv: In certain circumstances, HLuv may have to collect, use or release information without consent for its protection. For example, we may do so to detect, investigate or prevent fraud.
RETENTION
HLuv will keep your information only for as long as it is reasonably needed to fulfill the purposes for which it was collected, unless and to the extent a longer retention is permitted or required by law. Your information is destroyed when it is no longer needed or it is converted to an aggregated and anonymous form. The length of time we keep your information varies depending on the reason it was collected and the nature of the Personal Information. For legal reasons, we may keep information for as long as required by law or upon the advice of our legal advisors.
SAFEGUARDS AND SECURITY
HLuv employs safeguards, reasonably appropriate to the sensitivity of the Personal Information, to safeguard your Personal Information against loss, theft, misuse, unauthorized access or disclosure and alteration.
Although HLuv uses reasonable efforts to safeguard your Personal Information, we cannot guarantee it. HLuv cannot ensure or guarantee that any information you provide to HLuv is completely secure from individuals who might attempt to deliberately evade security measures, including by intercepting transmissions over the Internet. Therefore, we cannot warrant that any information, including any Personal Information, you transmit to us over the Internet is 100% secured and we accept no liability for any unintentional disclosure. You provide HLuv with your information at your own risk.

REVISIONS TO POLICY
HLuv reserves the right to modify this Privacy Policy from time to time. If amended HLuv will post an amended Privacy Policy on the Website with a date that will show you when the Privacy Policy was last revised.
It is your responsibility to review this Privacy Policy regularly and you are deemed to be aware of such amendments. We recommend that you visit the Privacy Policy page whenever you visit the Website to ensure you are aware of the terms of the current Privacy Policy.
